Prenuptial agreement or Cohabitation agreement

An important prerequisite to marriage or cohabitating in Thailand is to obtain a prenuptial agreement Listed are just a few reasons why.  Remember 50% of first marriages fail and 70% of second marriages fail!

  • Asset Protection: A prenuptial agreement helps protect the assets and property each spouse brings into the marriage, ensuring they remain separate in case of divorce or separation.

  • Debt Allocation: It can specify how existing debts will be divided, preventing one spouse from being responsible for the other's pre-marital debts.

  • Clarity and Communication: Creating a prenuptial agreement encourages open and honest communication about financial matters, promoting a better understanding of each other's financial goals and expectations.

  • Avoiding Lengthy Legal Battles: Having a prenuptial agreement can simplify and expedite the divorce process by clearly outlining the terms of asset division in advance.

  • Protecting Family Businesses: Inheritances or family-owned businesses can be protected from becoming marital assets subject to division.

  • Child Custody and Support: While prenups can't determine child custody arrangements, they can address how financial support for children from previous relationships will be handled.

  • Preserving Financial Independence: A prenup can safeguard the financial independence of both spouses, allowing them to manage their finances separately even while married.

  • Addressing Alimony or Spousal Support: It can define the amount and duration of spousal support, avoiding potential conflicts in the future.

  • Protecting Intellectual Property: For entrepreneurs or individuals with valuable intellectual property, a prenup can prevent it from being considered a marital asset.

  • Plan for the Unforeseen: A prenuptial agreement can address various scenarios, including death, disability, or a change in financial circumstances.

  • Protection from Debts Acquired During Marriage: Prenups can outline how debts acquired during the marriage will be divided, protecting each spouse from unexpected financial liabilities.

Remember that laws regarding prenuptial agreements vary by jurisdiction, so it's essential to consult with a legal professional to ensure the agreement complies with local laws and addresses specific needs and concerns.
